ATELIER ART FINANCE, LLC (the “Company” and referred to as “we” or “us” or “our”), is committed to protecting your personal information and privacy. This Privacy Policy (“Policy”) applies to personally identifiable information (“PII”) collected through the Company’s website at http://atelierartfinance.com/ (the “Site”) and explains how we collect and use PII and the steps we take to secure PII.

Collected PII Through the Site

In this Policy, PII includes your name, email address and postal mailing information as that is the only form of PII we currently receive through the “Contact” feature on our Site at http://atelierartfinance.com/contact/. By providing PII to us, you explicitly agree to our collection and use of such information as described in this Policy. The Policy only covers PII we receive through the Site. It does not cover any other personal information users provide to us in connection with any art loan transactions, which are not processed or consummated online and are subject to separate strict confidentiality provisions.

Cookies

This Site uses cookies to enhance your experience while using our Site. Cookies are small pieces of code that are transferred to a user’s computing device that is used for browsing. The cookies we use do not track your online movements beyond our own Site and do not capture any PII. Cookies we use include session ID cookies and shortterm persistent cookies. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for some extended period of time. You can remove persistent cookies by following directions provided in your Internet browser’s “help” file. We use these cookies for certain record-keeping purposes and to know which pages of our Site you are visiting or returning to. We do not use any tracking cookies.

This Policy does not apply to information that you may provide to us, or that we may obtain, through sources other than our Site, such as by phone, through postal mail and through other live and print media, including without limitation, information obtained from or provided to us by third parties.

We may also use your contact information to send you promotional emails about us, our services and upcoming events, including those sponsored by our affiliate, Ackerman’s Fine Art. You have the right to opt-out of receiving such promotional emails in the manner described below.

Additionally, if you contact us other than through the “Contact” feature on the Site, we may keep a record of your correspondence, including any personal information contained therein. A request for service, support, or information may be forwarded to third parties not affiliated with us, as needed to respond to the request.

Consent and Revisions

By using the Site, you agree to let us collect and use information per the guidelines of this Policy. If we revise our Policy, we will post changes on this page and note the effective date so that you are always aware of what information we collect and how we use it. We also will use reasonable efforts to contact you by email to provide notice of any such revisions.

If we materially change our practices regarding collection or use of your PII, your PII will continue to be governed by the Policy under which it was collected, unless you have been provided notice and have not objected to this change.

By submitting any PII through the Site, you understand and consent to the collection and use of such information, in accordance with this Policy, within the United States. If you are a resident of the European Union or other location outside the United States, please be advised that any information you provide to us will be transferred to the United States. By using this Site, you consent to this transfer and to the use of any PII you submit to us as described in this Policy. Please see the section below on Non-United States Users.

Children

This Site is a general audience website that is not intended for children. We do not knowingly collect PII from children under 13 years of age. If we learn that we have PII of a child under the age of 13, we will delete that information.

Non-Personal Information

The Site may also collect through cookies certain information that is not personally identifiable, such as IP addresses and related geographic regions, browser version, device information and operating system, as further described in the section above on Cookies.

We may use third-party providers to host our Site and help operate or promote our Site and services. We may share anonymous statistical information, but never PII, with these service providers and other third parties that provide services relating to the Site for our business.

Our third party analytics and Site hosting service providers maintain log files for traffic that visits our Site. We have access to this anonymous analytical data but we do not link any such information to PII. Log files are used to manage traffic loads and information technology requirements for providing reliable service. Information collected by our providers that may be reported to us includes browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp and clickstream data.

Legally Compelled Disclosures

We may disclose user information (which may include PII) to government authorities and to other third parties when compelled to do so by legal process, at our discretion, or otherwise as required or permitted by law, including but not limited to in response to court orders and subpoenas. We also may disclose user information as necessary when we have reason to believe that someone is causing injury to or interference with our rights or the Site, our customers or other users of the Site, or anyone else that could be harmed by such activities.

Right to Opt Out

If may opt-out from receiving our promotional emails by clicking on an opt-out or unsubscribe link within the e-mail you receive or by sending a message to our Contact email address set forth in the promotional email or on this Site. A request to opt-out of promotional emails will only apply as of the date of your request and may take up to 10 days to process, and during such time you may still receive promotional emails. Please understand that if you opt-out of receiving promotional emails from us, we may still contact you for administrative purposes in connection with your relationship, activities, transactions and communications with us, including to advise you of any revisions to this Policy or as may be required by applicable law.

Security

We use reasonable security methods to safeguard the information we collect from you through the Site. However, because no security system is impenetrable, we cannot guarantee the security of your data on the servers we use that are hosted by a third party provider. In addition, because Internet communication is generally unsecure, we cannot warrant the security of your information or guarantee that the information you transmit through our Site may not be intercepted, accessed, disclosed, altered or destroyed.

In the unlikely event we believe that the security of your PII data in our possession or control may have been compromised, we may seek to notify you of that development or take other actions as may be required by applicable laws. If a notification is appropriate, we would endeavor to do so as promptly as possible under the circumstances and in compliance with applicable laws, and if we have your e-mail address we may notify you by e-mail as well as by mail if we have your mailing address. You consent to our use of e-mail as a means of such notification.

Third Party Links

The Site provides links to our affiliate’s website Ackerman’s Fine Art, located at http://ackermansfineart.com/. The privacy practices of that affiliate site are subject to the privacy policy posted on that site and may differ from ours. If you submit PII to the Ackerman’s Fine Art site, your information is governed by the privacy policies of that site and is no longer governed by this Policy. We encourage you to carefully read the privacy policy of any websites you visit.

Business Transfers

In the event that the Company merges with or is acquired by a third party, or substantially all of our assets are acquired by one or more third parties, as a result of an acquisition, merger, sale, reorganization, consolidation or liquidation, PII may be assigned or transferred to our successor, merged entity or new owner of such assets.

California Privacy Rights

Users who reside in California and have provided their PII to us may request information about our disclosures of certain categories of PII to third parties for their direct marketing purposes under the California “Shine the Light” law. Such requests must be submitted to us in writing at the electronic mail address below. This request may be made free of charge once per calendar year. We reserve the right to not respond to requests submitted other than to the address specified below. If you are a California resident and would like to request such information, please see the How to Contact Us section below. At present, however, we do not share any PII with any third parties for their direct marketing purposes. For purposes of the California Online Privacy Protection Act, we do not track any online activity of our users beyond their use of our Site itself and we do not use any tracking cookies.

Non-United States Users

The Site is based in the United States and is intended for users who are located in the United States. This Policy shall be interpreted under the laws of the United States and the state of New York. If you are located outside of the United States, the PII you provide to us will be transferred to the United States, whose laws may not provide the same level of protection for PII as your home country. BY SUBMITTING ANY PII TO US THROUGH THE CONTACT FEATURE OF THE SITE OR OTHERWISE, YOU AFFIRMATIVELY CONSENT TO THIS TRANSFER.
